Scott Hershman is a trial lawyer focused on commodities, derivatives and securities law, white-collar criminal matters, internal corporate investigations and complex commercial civil litigation.

Mr. Hershman has represented a wide range of public corporations, financial institutions and individuals in investigations, civil litigations and enforcement proceedings involving the SEC, CFTC and NASD, and in related federal criminal investigations and private litigation. He has worked on numerous internal corporate investigations, including investigations involving commodities, securities and other financial frauds.

Recent representations include:

Represented the former CEO of Refco Capital Markets and Refco Securities in connection with the criminal investigation and prosecution of Refco and in related proceedings arising out of the US$2.5 billion Refco fraud.
Represented a former broker of MF Global in a joint investigation brought by the US Department of Justice, the Commodities Futures Trading Commission, and the Securities and Exchange Commission into an alleged US$600 million fraud involving the valuation of natural gas options positions by a major Canadian bank.
Represented the world's largest non-bank Futures Commission Merchant and its affiliated broker-dealer in securities fraud cases arising out of losses of more than US$100 million incurred by cities and counties in California and a financial institution in Denver, Colorado.
Acted as trial counsel for Philip Morris USA in numerous individual smoking and health product liability litigations in jurisdictions across the country.
Represents brokerage clients in disciplinary proceedings before the SEC, CFTC, and self-regulatory organizations, including the NASD, NYSE and various state securities agencies.
Represented art dealers, private collectors and art consultants in litigations involving issues of stolen art, authenticity and breach of contract.
Tried over 20 criminal felony cases as a prosecutor in New York.
