Michael Ciatti is a partner in King & Spalding’s Washington, D.C., office. He is a member of the firm’s Litigation and Antitrust Practice Group. His practice includes a broad range of civil and criminal matters that span a variety of industries, including financial services, professional services, and pharmaceuticals. Mr. Ciatti is Deputy Office Managing Partner for the Washington, D.C., office and serves on the firm’s Associate Evaluation Committee.

Representative experience includes:

Representing a Fortune 100 financial institution in parallel investigations by the Department of Justice and other agencies, such as the SEC, IRS, OCC, and various State Attorneys General, as well as parallel class action litigation.
Obtaining summary judgment for Federal Home Loan Mortgage Corporation (Freddie Mac) in suit by mortgage brokers in United States District Court for the Central District of California that included antitrust and defamation claims, and obtaining affirmance of that decision by the Ninth Circuit. Obtaining dismissal of separate suit by mortgage brokers against Freddie Mac in United States District Court for the Northern District of Alabama that included defamation, intentional interference with contract and conspiracy claims.
Defeating motion for preliminary injunction and obtaining dismissal of complaint in suit brought against Freddie Mac in the United States District Court for the District of Minnesota alleging violations of the 5th Amendment of the United States Constitution related to the Home Affordable Modification Program.
Obtaining dismissal of antitrust case brought against Freddie Mac in the United States District Court for the District of Columbia.
Defending Mylan Laboratories in a four-week jury trial in the United States District Court for the District of Columbia involving antitrust claims arising from exclusive supply agreements with API producers.
Representing The Coca-Cola Company with respect to government investigations related to whistleblower allegations.
Representing a legal permanent resident before the United States Supreme Court and lower courts in his successful appeal regarding the scope of a federal criminal statute that defines “crimes of violence” and provides a basis for removal from the United States. The Supreme Court, in an opinion authored by then-Chief Justice Rehnquist, issued a unanimous 9-0 decision, reversing the Eleventh Circuit and providing a complete victory to Mr. Ciatti’s client.
Advising a medical equipment company regarding issues related to FDA shutdown of manufacturer’s facility and termination of a distribution contract for the sale and distribution of medical equipment.
Defending a professional service firm in civil lawsuits brought in various federal and state courts alleging, among other things, fraud, malpractice and RICO violations.
Defending GrafTech International Ltd./UCAR International Inc. (UCAR) in a number of civil lawsuits brought in federal court alleging a world-wide conspiracy to fix prices and representing UCAR in an action brought against its former clients for illegal dividend and stock repurchase payments.
Representing a major textile company against its insurer in a $1.1 billion property loss and business interruption claim resulting from an industrial catastrophe.
Obtaining dismissal of claims against individual defendants in a lawsuit brought in the United States District Court for the Northern District of New York alleging breach of contract, fraud and RICO violations, arising out of partnership disputes related to shopping mall management.
